The Crosswicks Cemetery Association

Rules & Regulations

The Crosswicks Cemetery Association (CCA) is dedicated to providing and maintaining a tranquil and peaceful setting for the repose of deceased loved ones and conducive to reflection by surviving family, friends and visitors. As such, please understand that these rules and regulations are intended to foster these goals and to preserve, in perpetuity, the unique character of this country cemetery and its naturalistic setting. Their purpose is to facilitate care and maintenance of the cemetery and individual gravesites, at reasonable cost, consistent with our primary goal of honoring the memory of those interred here and enhancing the experience of visitors to this place. In furtherance of this purpose, and in accordance with applicable laws and regulations governing cemetery operation and management, all plots shall be held subject to the following rules and regulations:

OWNERSHIP AND USE OF PLOTS

  1. No plot in the Crosswicks Cemetery shall be used for any purpose other than as a place for burial of human remains. Concrete vaults are required for all interments.
  2. Plot or grave owners wishing to sell their plots may do so only to the Cemetery Board. The price to be paid for the plot will be based on, but not bound by, the original purchase price.
  3. Only plot owners may authorize a grave opening. A person requesting a grave opening must be authorized to do so by the plot owner as their agent and assumes full responsibility for having the grave opened.
  4. Plot owners shall pay the established charge for the opening and closing of the grave. All services shall be provided by a contractor approved by the CCA. No disinterment shall be allowed except by order of a court of competent jurisdiction or by consent of the CCA, which may require the written consent of the persons referenced under New Jersey law in such cases and of the legal owners of the plot.
  5. No burial shall be allowed in any plot against which there shall appear on records of the CCA any default in payments or failure to meet the obligations under these rules, until all arrears are paid and failures cured.
  6. CCA shall have the right to move over or place on any grave or plot the necessary personnel and equipment to conduct an interment, or to maintain, dig and fill graves.

CARE AND MAINTENANCE

  1. Each plot holder shall keep in repair at his/her own expense the improvements thereon.
  2. A plot owner may not plant, cut down or remove any trees or shrubs without permission from the CCA.
  3. The CCA shall have the right to require the plot or grave owner to remove any trees, shrubs, fences or anything which may be deemed detrimental to the care or beauty of the cemetery. If necessary, the CCA shall have the right to undertake the removal. If any trees, shrubs or plants situated in any lot shall by reason of their roots, branches or otherwise become detrimental to the adjacent lots or paths or roadways or shall become unsightly, inconvenient or dangerous to pedestrians or motorists or to the efficient operation of the cemetery, the CCA, in its sole discretion, shall have the right to remove same.
  4. The CCA may take such action as it deems necessary to keep the cemetery plots neat and clean. It may cut or clear grass or weeds, remove broken stones etc. and dispose of same.
  5. All flowers, plants or other decorations shall be placed within 12 inches of the headstone for better protection from mowing.
  6. For any special work requested, plot holders are required to prepay to the CCA all labor and materials charges.
  7. Headstones, slabs and other monuments which have fallen or which require repair may be removed by order of the CCA unless replaced or repaired by the lot owners within 30 days of written notification by mail addressed to the last known address on record with CCA, or by electronic means, if address is available to the CCA. The CCA is not responsible for markers/monuments affected by theft, vandalism or acts of God.
  8. All grave markers other than headstones must be flush with the ground. This rule applies to the replacement of present monuments, stones and markers, however, this requirement shall not prevent the installation of a suitable headstone upon each plot.>
  9. All rubbish resulting from actions by plot holders or other persons acting with their consent or under their direction must be removed immediately to such places of deposit as are provided for that purpose.
  10. The enclosure or fencing of any plot, grave or portion thereof is not permitted.
  11. No work on a cemetery plot undertaken by or with the consent of a plot holder shall be left in an unfinished state. Should this occur, the CCA may finish the work and charge the expense to the plot holder.
  12. Live flowers/shrubs and/or artificial flowers/shrubs placed on lots for decorative or seasonal reasons may be removed by the CCA when, in the sole opinion of CCA, they have died or their appearance is unsightly or they remain beyond the appropriate season. The need for this action shall be at the sole discretion of CCA.
  13. Nothing herein shall obligate the CCA to render any service or maintenance without compensation from the lot owner, except for routine perpetual care, which is included in the purchase price of a grave site.
  14. Lighting of any kind is not permitted. This includes but is not limited to battery, solar and candles.

EXCEPTIONS: There shall be no exceptions to these rules, except by written permission of the Crosswicks Cemetery Association (CCA) Board of Directors. The CCA may from time to time revise these rules and regulations as may be necessary for the proper administration and management of the cemetery, without notice to plot owners.
